Immigrant Investor (EB-5)

EB-5 visas provide a pathway to U.S. legal permanent residence to persons who:

 

  • Invest $1,000,000 in a new commercial enterprise which creates 10 full-time jobs for U.S. citizens or authorized immigrant workers (not including persons in the U.S. on nonimmigrant visas); or

  • Invest $500,000 in a new commercial enterprise located in a high unemployment or rural area, which creates 10 full-time jobs for U.S. citizens or authorized immigrant workers (not including persons in the U.S. on nonimmigrant visas).

 

In addition, to qualify for an EB-5 visa, the investor must engage in the new enterprise’s day-to-day business or policy formation.  If the new enterprise is a limited partnership, this criterion is usually satisfied if the investor’s powers and duties are powers and duties normally granted to limited partners pursuant to the Uniform Limited Partnership Act.  This is the structure usually employed by "regional centers" in accepting investors.
