TN Visa: NAFTA Professional

The NAFTA Professional (TN) visa allows citizens of Canada and Mexico to work in the United States in prearranged business activities for U.S. or foreign employers. The following minimum conditions must be met in order for an applicant to qualify for a TN visa:

  • Applicant is a citizen of Canada or Mexico;

  • Profession is one of a list of professions enumerated in NAFTA. These professions include accounting, dentistry, nursing, graphic design, engineering, and management consulting;

  • Position in the United States requires a NAFTA professional;

  • Applicant will work in a prearranged full-time or part-time job for an employer. Self employment is not permitted;

  • Applicant has the qualifications, meeting the specific requirements, education, and/or experience, of the profession.

Duration of Visa

The TN visa allows for an initial stay of three years in the U.S. After this initial period, the visa may be renewed. There is no limit to the number of available renewals.

Family Visa Eligibility

Spouses and minor children (under 21 years of age) of TN visa holders may apply for a TD visa, which allows them to accompany TN visa holders during their stay in the U.S. TD visa holders are not allowed to work in the U.S.

How We Can Help

A foreign national’s eligibility for a TN visa will depend on a variety of factors, including his/her professional qualifications, personal background, and the type of employment he/she intends to carry on in the United States. We have experience with highly complex immigration filings and can prepare petitions for a broad variety of occupational fields. Our multi-disciplinary background in engineering and business is a significant asset, enabling us to fully comprehend and accurately describe the background and qualifications of our technical and business clients. In addition to our legal expertise, our language skills in Spanish and Portuguese make us particularly helpful to our Mexican clients.
