Daniel Berner

Founding Attorney

Daniel's practice focuses on employment-based nonimmigrant visas (H-1B, E-2, E-3, L-1, O-1, TN) and immigrant visas (EB-1A, EB-1C, EB-2, and EB-3), as well as investor visas (E-1/E-2, L-1). Daniel has represented employers in the high technology, heavy construction, advertising, consumer packaged goods, telecommunications, sports, accounting, telemedicine, dental, and legal fields. He has prepared hundreds of successful nonimmigrant and immigrant visas for professionals from a broad variety of disciplines, including software engineers, electrical engineers, doctors, mechanical engineers, computer scientists, civil engineers, advertising executives, attorneys, accountants, dentists, and professional athletes.


Representative matters include: representation of one of the ten largest global cryptocurrency exchanges with respect to all immigration matters; representation of NASDAQ 100 Index company with respect to hundreds of H-1B petitions and PERM-based green card applications; representation of U.S. subsidiary of one of the top 10 largest private companies in Latin America with respect to all immigration matters; representation of U.S. subsidiary of one of the ten largest European engineering and construction companies with respect to all immigration matters; representation of portfolio company belonging to one of Latin America's five largest investment banks with respect to all immigration matters; representation of venture-backed hyperloop technology developer with respect to extraordinary abilities green card petitions; representation of numerous venture-backed technology and healthcare startups throughout the United States with respect to all immigration matters; representation of clinics in dental and medical professions.


In addition to representing companies, Daniel also has extensive experience counseling individuals with respect to investment-based U.S. immigration and family immigration matters.

Daniel is a frequent commenter on matters of immigration. He has testified before the Texas House of Representatives' Business & Industry Committee and has frequently been interviewed on immigration and employment matters on television and the radio.


Daniel maintains a robust pro bono practice. He has twice been recognized by Sanctuary for Families (New York non-profit organization) with its annual Above and Beyond Award for his pro bono advocacy on behalf of immigrants. He has also been a recipient of the American Gateways' Pro Bono Award. Daniel has served as Vice President of the board of directors of the Workers Defense Project, a non-profi t organization described by the New York Times as "one of the nation’s most creative organizations for immigrant workers," and he has served as a Commissioner on the City of Austin MBE / WBE / Small Business Enterprise Procurement Program Advisory Committee

pursuant to an appointment by Austin City Council Member, Paige Ellis, and confirmation by the Austin City Council.


Daniel received a law degree (Juris Doctor) from Georgetown University in 2007 and a Bachelor of Science in mechanical engineering from The University of Texas at Austin in 2002. He is fluent in Portuguese and Spanish. Before founding Berner Law, PLLC, Daniel worked as an associate at Cleary Gottlieb Steen & Hamilton LLP in New York City. Before attending law school, Daniel was an Assistant Brand Manager at Procter & Gamble.
